Terms of Service
Last updated: August 2026. These terms govern all engagements with Digitech Monster.
1. Acceptance of Terms
By accessing our website or engaging our services, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, please do not use our website or engage our services. These terms apply to all clients and website visitors.
2. Services Provided
Digitech Monster provides digital marketing, marketing automation, brand identity design, web design and development, social media management, and related digital services. The specific scope, deliverables, timeline, and pricing for each engagement are defined in a separate proposal or service agreement agreed upon before work begins.
3. Client Responsibilities
Clients agree to provide timely access to necessary accounts, platforms, branding assets, and information required to deliver the agreed services. Delays caused by lack of client input or access may affect project timelines. Clients are responsible for the accuracy of all information provided to us.
4. Payment Terms
Payment terms are specified in each service agreement. Unless otherwise agreed, invoices are due within 7 days of issuance. For retainer-based engagements, payment is due in advance of each billing cycle. Late payments may result in suspension of services until the outstanding balance is settled.
5. Intellectual Property
Upon full payment of all applicable fees, ownership of final deliverables (designs, websites, content, automation workflows) transfers to the client, excluding third-party tools, fonts, and stock assets which remain licensed under their respective terms. Digitech Monster retains the right to showcase completed work in its portfolio unless a non-disclosure agreement is in place.
6. Confidentiality
We treat all client information as confidential. We do not disclose client data, business strategies, or proprietary information to any third party without express written consent. Mutual NDAs are available upon request for sensitive engagements.
7. Service Modifications
We reserve the right to modify, suspend, or discontinue any aspect of our services with reasonable notice. For active engagements, any material changes to scope or approach will be discussed and agreed upon with the client before implementation.
8. Limitation of Liability
Digitech Monster is not liable for indirect, incidental, or consequential damages arising from the use of our services. Our total liability for any engagement is limited to the total fees paid by the client for the specific service in question. We are not responsible for outcomes resulting from factors outside our control, including platform policy changes, market conditions, or third-party service disruptions.
9. Termination
Either party may terminate an engagement with 30 days written notice. Fees for work completed up to the termination date are payable in full. Pre-paid retainer fees for periods beyond the termination date will be refunded on a pro-rata basis.
10. Governing Law
These terms are governed by the laws of the Islamic Republic of Pakistan. Any disputes arising from these terms or our services will be resolved through good-faith negotiation first, and if necessary, through arbitration in Lahore, Pakistan.
11. Changes to Terms
We may update these Terms of Service periodically. Changes will be posted on this page with an updated revision date. Continued use of our services after changes constitutes acceptance of the updated terms.
